主旨：有關「自行車產品出口歐盟監控小組」第2次會議，本會意見如說明，敬請　

卓參。

說明：

一、            依據95年4月19日經濟部國際貿易局貿服字第09501508200號函辦理。

二、            歐盟於本(95)年4月8日，於C85期歐盟公報第5頁中，公告修訂對自行車

　　　之關稅分類規定。於新公告之歐盟調合稅則分類中，歐盟將非完整之自行車，

　　　不論其是否已組裝完成或未組裝，倘其具有車架、前叉、及包括至少二組車輪

　　　或轉向機制等在內之相關零組件，因已具有完整自行之主要特性，應歸類於

第871200目項下。(附件1)

三、            根據本會解讀，歐盟此次對於關稅分類規定之修正，應有以下目的：1.阻止

中國大陸及越南的自行車零組件以「未組裝」方式，藉申報在其他稅號下進

口歐盟，以規避反傾銷稅；2.阻止我國等第三國的業者，以化整為零的方式，

轉運自行車產品至歐盟，規避反傾銷稅；3.由於整車稅號下之進口數量及金

額，將因此次修正而增加，在某種程度上，此次修正將便利歐盟對自行車產

品進口情況之管控，以及降低歐盟產業未來申請反傾銷／反規避調查之資料

門檻。

四、            鑒於此項措施頃於本年4月8日公告實施，且由於海關統計資訊之時間落差，

此關稅分類之修正，對我國輸歐自行車產品在統計數量及金額上之衝擊，仍

待後續釐清。因此本會建議「自行車產品出口歐盟監控小組」，應對此措施之

可能影響進行討論與評估，並密切注意自行車產品在歐盟海關統計資料中之

數量及金額變化。

Explanatory notes adopted in accordance with the procedure defined in Article 10(1) of Council Regulation (EEC) No 2658/87 of 23 Jul 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff(1)

 

The explanatory notes to the Combined Nomenclature of the European Communities’(2) shall be amended as follows:

 

On page 357:

871200      Bicycles and other cycles(including delivery tricycles),not motorised

Insert the following text:

This heading includes incomplete bicycles that have the essential

characteristics of complete bicycle (General rule 2(a) for the interpretation

of the Combined Nomenclature).

An incomplete bicycle, whether or not assembled, is to be classified under

heading 8712 if it consists of the frame, the fork and at least two of the

following components:

－ a set of wheels;

－crank-gear (including axle, crank);

－ steering unit (including handlebar and handlebar stems);

－a brake system.
